Mr. Derby’s practice areas include labor and employment, corporate, and commercial law. His practice includes counseling in, and drafting and negotiation of, individual employment contracts, collective bargaining agreements, severance agreements, employment policies and work rules, commercial vendor/supplier agreements, lending documents, and asset and stock acquisition agreements.
Mr. Derby also regularly advises private and public sector employers on a variety of employment matters involving hiring, promotion/demotion, reductions-in-force, progressive discipline and termination, severance of highly compensated employees, family medical leave compliance, disabilities discrimination and accommodation, and race/gender discrimination issues. Mr. Derby also presents seminars on labor and employment issues for employer groups and in university management courses.
Mr. Derby has represented clients before the Unites States Circuit Court of Appeals for the Sixth Circuit, United States District Court for the Eastern District of Michigan, United States Bankruptcy Court for the Eastern and Western Districts of Michigan, National Labor Relations Board, Equal Employment Opportunity Commission, Michigan Circuit Courts and Court of Appeals, Michigan Department of Civil Rights, Michigan Employment Relations Commission, and Michigan Employment Security Commission.
